1. Agreement to Terms

By accessing or using Fluentia ("Service"), operated by Arendt Digital LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

Fluentia is a language learning platform that provides AI-powered conversations, interactive stories, grammar games, flashcards, and other educational tools to help users learn new languages. The Service uses artificial intelligence from third-party providers to generate content and facilitate learning.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason we deem necessary. You may delete your account at any time by contacting us at dev@arendtdigital.com.

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Violate or infringe upon the rights of others
  • Transmit any harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the Service without permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Remove any copyright or proprietary notices

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Arendt Digital LLC and are protected by international copyright, trademark, trade secret, and other intellectual property laws.

You retain ownership of content you create using the Service. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and transmit your content as necessary to provide and improve the Service, including sharing your content with third-party AI providers (such as Google Gemini, OpenAI, and DeepL) for processing as part of the Service's core functionality.

6. AI-Generated Content

The Service uses artificial intelligence to generate educational content, including conversations, stories, grammar exercises, translations, and other learning materials. You acknowledge and agree that:

  • AI-generated content may contain errors, inaccuracies, or inappropriate responses
  • The Service is an educational tool and is not a substitute for professional language instruction, certified translation services, or academic credentials
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated content
  • You should not rely solely on the Service for critical translations or communications

7. Payment Terms

7.1 Subscription Fees

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis.

7.2 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. Your payment method will be charged at the then-current subscription rate. You may cancel auto-renewal at any time through the Stripe customer portal or by contacting us.

7.3 Third-Party Marketplaces

Important: If you purchase or subscribe to Fluentia through a third-party marketplace (such as the Apple App Store, Google Play Store, or other app marketplaces), your subscription, billing, cancellation, and refund requests are managed entirely by that marketplace according to their terms and policies. We do not have access to or control over marketplace subscriptions. For any billing or refund issues related to marketplace purchases, you must contact the marketplace directly.

7.4 Price Changes

We reserve the right to change our pricing at any time. We will provide at least 30 days' notice of price changes, and changes will apply to subsequent billing periods.

7.5 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period, and you will retain access until then. If you subscribed through a third-party marketplace, you must cancel through that marketplace.

7.6 Refunds

Refunds are not guaranteed. For subscriptions purchased directly through our website, we handle all refund requests on a case-by-case basis. We take technical issues seriously and prioritize refund requests that include detailed error reports, screenshots, or logs that help us improve the app. To request a refund, contact us at dev@arendtdigital.com with your order details and explanation.

For marketplace purchases: If you purchased through the Apple App Store, Google Play Store, or another marketplace, refunds are subject to that marketplace's refund policy. You must request refunds directly through the marketplace. We cannot process refunds for marketplace purchases.

Note: Fluentia is developed and maintained by a solo developer with limited resources. We appreciate your understanding and patience.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

As an independent, solo-developed application, we cannot guarantee:

  • Uninterrupted service or 24/7 availability
  • Immediate bug fixes or feature updates
  • Data backup or recovery services
  • Dedicated customer support
  • Accuracy of AI-generated content

Users are encouraged to maintain their own backups of important data.

9. Support and Service Level

Fluentia is an independent project developed and maintained by a solo developer. While we strive to provide a quality experience, please note:

  • Support is provided on a best-effort basis with no guaranteed response times
  • We typically respond to emails within 2-5 business days
  • Technical issues are prioritized based on severity and impact
  • We may not be able to accommodate all feature requests or customizations

  • AI Support Assistant: Get instant answers to common questions about Fluentia features, troubleshooting, and usage
  • FAQ & Help Documentation: Self-service guides for common topics

For Paid Subscribers:

  • Email Support: Direct support at dev@arendtdigital.com with response within 2-5 business days
  • Priority for technical issues and bug reports
  • AI Support Assistant and FAQ also available

We encourage users to be patient and understanding as we work to continuously improve the platform.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ARENDT DIGITAL LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR PERSONAL INFORMATION; (C) ANY ERRORS, INACCURACIES, OR OMISSIONS IN AI-GENERATED CONTENT; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Arendt Digital LLC, its owner, members, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. For material changes, we will make reasonable efforts to notify you (such as a notice within the application). Your continued use of the Service after such changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Oakland County, Michigan. You consent to the personal jurisdiction of such courts.

16. General Provisions

16.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16.2 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and Arendt Digital LLC regarding the Service and supersede all prior agreements and understandings.

16.3 Waiver

The failure of Arendt Digital LLC to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction (for example, in connection with a merger, acquisition, or sale of assets).

16.5 Electronic Communications

By using the Service, you consent to receiving electronic communications from us (such as emails and in-app notifications). You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
